Marriage in Istanbul for Foreign Nationals

Istanbul is divided into 39 districts, and marriages involving foreign nationals are carried out by the marriage registries of the district municipalities and by the population directorates. The law that applies is the same in every district. What changes from one couple to another is which registry is competent, which documents the spouses' home countries issue and how each registry handles the file. This page outlines those points and explains where a preliminary legal review is most useful.

Which registry receives the application

As a rule, the application is made to the marriage registry of the place where one of the spouses resides (Marriage Regulation, art. 16). In a city with as many districts as Istanbul, this means the spouses' registered address usually determines where the file is submitted. Establishing the competent registry first avoids preparing documents for an office that cannot accept the application.

The legal framework in brief

A Turkish citizen and a foreign national, or two foreign nationals, may marry before the competent Turkish marriage registrar. Where at least one spouse is a foreign national, the procedure and form rules that apply to Turkish citizens apply as well (Marriage Regulation, art. 12). Two foreign nationals of the same nationality may also marry before their own state's representation in Türkiye if their national law permits.

Documents and the role of consulates

The central document is the certificate of capacity to marry, which confirms that there is no impediment to the marriage under the spouse's own law (Marriage Regulation, art. 20). Many states maintain consulates in Istanbul, which can be a practical route for obtaining it. Each state, however, has its own rules on who issues the certificate, in what form and with which authentication. Certificates issued by honorary consulates are not accepted as a basis for the marriage. Civil status documents, such as a birth certificate or proof that a previous marriage has ended, may also be requested. Checking each document against the registry's expectations before the application helps prevent repeated visits.

The process at a glance

1. Nationality and civil status review: deciding which documents are likely to be needed.

2. Obtaining the certificate and other documents: from the home country's authorities or its consulate.

3. Authentication and translation: in the form the issuing country and the registry require.

4. Health report and any additional tests: some registries ask for more than the general rules require.

5. Application and appointment: submission to the competent district registry and scheduling of the ceremony.

6. Registration: after the ceremony, a family booklet and, on request, a multilingual marriage certificate are issued (Marriage Regulation, art. 34), and the marriage is recorded in the civil registry.

Differences between districts

Registries publish their own guides, and lists of documents, additional tests and appointment procedures can differ from one district to another and can change over time. For the same reason, information that applies to one city or district should not be assumed to apply to another. The current guide of the registry that will receive the application is the reference.

Planning the timeline

Appointment availability can vary between districts and periods, and documents obtained abroad take time to issue and authenticate. Some documents are accepted only for a limited time after their date of issue. It is therefore sensible to sequence the steps and begin the document work well before the intended date.
